Terms of Service

1. Acceptance of Terms

By accessing or using Shacked ("the Service") at shacked.surf or via our iOS application, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by oscon e.U., contactable at hello@shacked.surf.

2. Forecast Disclaimer — Safety Warning

Shacked provides surf forecasts and conditions data for informational and recreational planning purposes only. Forecasts are not a substitute for real-time local observation, professional maritime advice, or your own judgment in the water.

Surfing is an inherently dangerous activity. Conditions at any surf spot can change rapidly and unpredictably. Wave height, current, reef, rocks, wildlife, weather, and other hazards can cause serious injury or death.

AI-generated surf reports on the Service are produced by a large language model and may contain errors, inaccuracies, or outdated information. They do not account for real-time local hazards. Never make safety-critical decisions — including whether to enter the water — based solely on information from this Service.

You assume full responsibility for any decisions you make based on information provided by Shacked.

3. Limitation of Liability

To the maximum extent permitted by applicable law, Shacked, its operators, employees, and contributors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from:

• Your use of or reliance on forecast data or AI-generated reports
• Any injury, death, loss, or damage incurred while surfing or engaging in water activities
• Interruption, inaccuracy, error, or omission in the Service
• Any third-party data, links, or content accessible through the Service

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the greatest extent permitted by law.

4. Use of the Service

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:

• Scrape, copy, or redistribute our data or content at scale without written permission
• Attempt to reverse-engineer, disrupt, or overload the Service
• Use the Service to transmit harmful, offensive, or illegal content
• Impersonate another person or misrepresent your affiliation with any entity
• Use automated tools to access the Service without prior written consent

5. Accounts

You may create an account using Google Sign-In. You are responsible for maintaining the security of your account and for all activity that occurs under it. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

You may delete your account at any time from within the app. Upon deletion, your personal data will be removed from our active systems within 30 days, subject to any retention required by law.

6. AI-Generated Content

The surf report feature uses an AI language model (provided by Anthropic, Inc.) to generate text based on wave, wind, and swell data for a given location. AI-generated reports are clearly labelled as such within the Service.

AI reports are generated content and may be inaccurate, incomplete, or misleading. They are provided as a convenience only. See Section 2 for the full safety disclaimer.

7. Intellectual Property

All original content on shacked.surf — including blog posts, design, code, and branding — is owned by Shacked or its licensors and is protected by copyright. You may share links to our content and quote brief excerpts with attribution, but may not reproduce it in full without permission.

Forecast data is sourced from third-party providers (Open-Meteo, WorldTides) under their respective licences. Surf spot data may include publicly available information. We make no claim of ownership over third-party data.

8. Third-Party Services

The Service relies on third-party providers including Supabase (database and authentication), Google (OAuth sign-in), Anthropic (AI reports), Open-Meteo (forecast data), and WorldTides (tide data). Your use of those services is also subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

9. Service Availability

We provide the Service on a best-effort basis. We do not guarantee uninterrupted access and may suspend or discontinue the Service at any time, with or without notice. We will make reasonable efforts to notify users of any planned downtime.

10. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date at the top of this page. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

11. Right of Withdrawal

If you are an EU consumer, you have the right to withdraw from this contract within 14 days of account creation without giving any reason.

However, by creating an account and using the Service, you expressly request that we begin providing the Service immediately. If the Service has been fully performed within the 14-day withdrawal period, you acknowledge that your right of withdrawal is lost upon full performance. As the Service is provided free of charge, no refund is applicable in any case.

12. Consumer Dispute Resolution

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board, but we are willing to do so where possible. A list of certified consumer dispute resolution bodies in EU member states is available at: consumer-redress.ec.europa.eu/dispute-resolution-bodies.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Austria. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Austria. Nothing in these Terms limits your rights under mandatory consumer protection laws in your country of residence — if you are an EU consumer, you retain the protection of the laws of your country of residence to the extent they are more favourable.
